Terms of Service

Pavilia is a trip planner. For most things — tickets, rooms, trains, rides — it sends you to the partner who sells them. For local tours from selected operators, Pavilia takes your booking and payment as the operator’s agent. Both are explained below.

The agreement

These terms are between you and Pavilia, LLC, 57 South Drive, Plandome, NY 11030, USA (“Pavilia”, “we”). By using Pavilia you accept them. If you do not, please do not use the service.

You must be at least 18 years old to create a Pavilia account or to book a paid tour, and a tour operator may set a higher minimum age for its tour.

What Pavilia is — and is not

Pavilia helps you plan a trip around a live event: the event itself, how you get there, where you stay, where you eat, and how you get around. Every one of those steps ends with a link out to a partner’s own website.

For everything except local tours, Pavilia is not a travel agency, tour operator, ticket seller or merchant of record. For those steps it takes no payment, holds no money, reserves no inventory and issues no tickets — a trip step is booked only when you complete it on the partner’s site, under that partner’s terms, and only that partner can cancel, change or refund it.

Local tours are different. Where a tour card says “Request to book”, Pavilia collects your payment and issues your voucher as the tour operator’s agent. The section “Tour bookings” below governs those.

Tour bookings

  1. Role. The operator named on the tour page provides the tour and is the party you contract with for it. Pavilia arranges the booking and collects your payment as that operator’s agent. Pavilia does not provide the tour.
  2. Request, not confirmation. Submitting a request does not create a booking. Your booking is confirmed only when we send you a voucher after the operator confirms availability, normally within 24 hours.
  3. Authorisation hold. When you submit a request we authorise (hold) the full amount on your card in euro. We charge the card only when the booking is confirmed. If we cannot confirm within 24 hours, or the operator declines, we release the hold and you pay nothing. Your bank may take a few business days to show a released hold.
  4. Price and currency. Prices are shown and charged in euro (EUR) and include VAT. The price shown per person is the full price; Pavilia adds no booking fee. Your card issuer sets its own exchange rate and may add a foreign-transaction fee, which we do not control or receive.
  5. Cancellation and refunds.
    • If the operator cancels or cannot run the tour, you get a 100% refund to your original card within 10 business days.
    • If you cancel, the operator’s cancellation policy shown at the time of booking applies. Pavilia charges no cancellation fee of its own.
    • If we cannot confirm your request within 24 hours, the hold on your card is released and nothing is charged.
    • No refund for no-shows, late arrival or leaving early, unless the operator’s policy says otherwise.
    • If the operator materially changes the tour and you do not accept the change, you get a full refund.

To cancel a request before it is confirmed, use Cancel request on your booking; to cancel at any time, email info@pavilia.ai. The time we receive your request decides which cancellation deadline applies.

  6. No right of withdrawal. A tour is a leisure service on a fixed date. Once confirmed, no statutory cooling-off or withdrawal right applies; the cancellation policy above is what applies.
  7. Changes by the operator, force majeure. Itineraries, guides, venues and start times may change for safety, weather, strikes, closures or other events outside the operator’s or Pavilia’s control. If the tour cannot run at all, clause 5 applies; if it runs in modified form, no refund is due unless the change is material.
  8. Voucher and redemption. Your voucher is sent by email and, if you opted in, by SMS. Bring it and photo ID matching the booking name to the meeting point. Vouchers are personal and not transferable unless the operator’s policy says otherwise.
  9. Participant requirements. Tours involve walking, stairs and uneven ground and, where the tour page says so, alcohol tasting. Read the tour’s requirements before booking. You are responsible for deciding you are fit to take part, for telling the operator about any condition that matters, and for meeting age, ID and dress requirements. The operator may refuse anyone who does not meet them or appears intoxicated, without refund.
  10. Risk and liability for the tour. You take part in a tour at your own risk. To the fullest extent the law allows, Pavilia is not liable for injury, illness, loss or damage arising from the tour or from the acts or omissions of the operator or its staff. The operator may ask you to sign its own waiver on the day.
  11. Insurance. Neither Pavilia nor the operator provides travel or accident insurance. We recommend travel insurance that covers activities abroad.
  12. Age. You must be 18 or older, and the cardholder or authorised by the cardholder, to book.
  13. Data. To fulfil your booking we share your name, party size, contact details and anything you tell us about requirements with the operator; Stripe processes your payment. See the Privacy Policy.
  14. Disputes about a charge. Contact us before disputing a charge with your bank; most issues are resolved within two business days. Questions about the tour itself are for the operator under its terms.

Prices and availability are estimates

Figures shown in Pavilia are estimates, assembled from partner search results and from our own suggestions. They are not quotes and not offers. Prices and availability change constantly, and the only price that is real is the one on the partner’s checkout at the moment you pay. The exception is a tour with a “Request to book” price, which is the price you are charged.

Trip totals in the planner cover a deliberately narrow scope, stated on screen next to the figure. Do not read a total as the full cost of a trip.

We try to keep suggestions accurate but do not warrant that any listing, price, time, address or availability is correct.

How Pavilia makes money

Pavilia is free to use. When you click through to a partner and book something, that partner may pay us a commission. This never adds anything to your price — you pay the partner’s own price, and Pavilia adds no markup and charges no booking fee.

Being paid a commission does not mean a partner has been vetted or endorsed by us. Some partners we link to pay us nothing at all.

For tour bookings, the operator pays Pavilia a commission out of the price you pay. The price is the same as the operator’s own price for that tour unless the tour page says otherwise.

Your account

Keep your sign-in secure and let us know if you think someone else has used it. You are responsible for what happens under your account. You can close it at any time — see the Privacy Policy for what happens to your data when you do.

Text messages (SMS)

If you opt in, Pavilia, LLC sends you Pavilia Trip Alerts: recurring automated text messages about your trips and tour bookings. Message frequency varies, up to 10 messages per month. Message and data rates may apply. Reply STOP to cancel or HELP for help. Consent is not a condition of purchase. The full SMS Terms & Conditions are at /sms-terms.

What you post

Pavilia has a student forum and lets you publish an itinerary for others to browse and copy. You keep ownership of what you write. By posting it, you give us permission to display and distribute it within Pavilia, and you allow other students to copy a published itinerary into their own plan — which is the point of publishing it.

A published itinerary is an immutable snapshot: it does not change when you later edit your own trip. Withdraw it and it stops being shown.

Do not post anything that:

  • is not yours to post, or infringes someone else’s rights;
  • harasses, threatens or targets another person;
  • is spam, an advertisement, or a scheme to drive clicks;
  • is unlawful, or is another person’s private information.

We may remove content or suspend an account that breaches these terms. You can report a post from the post itself.

Acceptable use

Use Pavilia normally. Do not scrape it, automate it, resell it, probe it for vulnerabilities, or interfere with anyone else’s use of it. Do not attempt to inflate outbound-click records or otherwise manipulate how we are paid.

Availability and liability

Pavilia is provided as-is. It is early-stage software: it may be unavailable, may change, and may contain errors. We do not warrant that it will be uninterrupted or accurate.

We are not responsible for anything a partner does or fails to do. A cancelled flight, an oversold hotel, a missed reservation or a refused refund is a matter between you and that partner. Pavilia was never a party to it. For tours booked through Pavilia, the “Tour bookings” section applies as well.

To the extent the law allows, Pavilia’s total liability to you for all claims arising from or relating to these terms or the service is limited to the greater of US$100 or the amounts you paid to Pavilia in the 12 months before the event giving rise to the claim. This limit does not apply to liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for gross negligence or wilful misconduct, or to any liability that cannot be limited by law.

Changes, and ending the agreement

We may update these terms; the date at the top will change and material changes will be flagged. You can stop using Pavilia at any time. We may suspend or end access for a breach of these terms.

Governing law

These terms are governed by the laws of the State of New York, USA, without regard to its conflict-of-laws rules. Any dispute will be resolved exclusively in the state or federal courts located in Nassau County, New York, and you and Pavilia consent to their jurisdiction. Nothing in these terms takes away mandatory consumer-protection rights you have under the law of the country where you live, including the right to bring a claim in your local courts.
